Domain Registration Terms

These Domain Registration Terms (“Terms”) govern the registration, renewal, transfer, and management of domain names facilitated by Lab41 (“we”, “us”, “our”) on behalf of clients. By engaging Lab41 to register or manage a domain name you (“Registrant”) agree to be bound by these Terms, by the Nominet Terms and Conditions of Domain Name Registration, and by the Nominet Rules of Registration (each as amended from time to time).

1. Definitions

In these Terms:

  • Domain Name means any .uk, .co.uk, .org.uk, .me.uk, or other domain name registered through Lab41.
  • Nominet means Nominet UK, the registry operator for .uk domain names.
  • Register means the register of .uk domain names maintained by Nominet.
  • Registrar means the accredited registrar through which Lab41 processes domain name registrations.
  • DRS means the Nominet Dispute Resolution Service.
  • WHOIS means the publicly accessible registration data lookup service.

2. Scope of Services

Lab41 facilitates domain name registration, renewal, DNS management, and related administrative services on behalf of the Registrant through accredited registrars. Lab41 is not itself an accredited registrar; we act as an intermediary managing registrations on your behalf.

3. Registration Requirements

When registering a .uk domain name the Registrant must:

  • Select the appropriate Legal Type (e.g. UK Individual, UK Limited Company, Non-UK Individual, etc.) as required by Nominet.
  • Ensure the domain name consists of 3–63 characters, using only the letters a–z, digits 0–9, and hyphens (hyphens may not appear at the start or end).
  • Note that .me.uk registrations are restricted to natural persons only.

There is no residency or nationality requirement for registering .co.uk or .uk domain names.

4. Registrant Obligations

The Registrant warrants and undertakes that:

  • All registration data (name, postal address, telephone number, and email) is accurate and complete at the time of registration and will be kept up to date throughout the registration period.
  • Permission has been obtained from any person whose personal data will be held on the Register.
  • The registration or use of the domain name does not infringe the intellectual property rights of any third party.
  • The alphanumeric characters of the domain name are not proscribed under Nominet’s rules.
  • The domain name will not be used for any unlawful purpose.
  • The Registrant will promptly notify us of any legal proceedings involving the domain name.

For non-consumer Registrants: the Registrant agrees to indemnify Nominet for all reasonable costs, claims, and expenses (whether direct or indirect) arising from a breach of these obligations. This indemnity survives cancellation or transfer of the domain name.

5. Security and Credentials

The Registrant is responsible for keeping all identification codes, passwords, and login credentials used to manage the domain name confidential. Nominet and registrars are entitled to assume that any request received using valid credentials has been authorised by the Registrant. The Registrant should contact Lab41 in the first instance for any domain management queries; Lab41 will liaise with the registrar on your behalf.

6. Fees and Payment

Registration, renewal, transfer, and redemption fees are agreed separately under our service agreement or as quoted at the time of purchase. All fees are exclusive of VAT unless otherwise stated. The correct fee must be received before any registration or renewal is processed.

Nominet may cancel a domain name without further notice if any debt relating to it remains unpaid. Lab41 accepts no responsibility for losses arising from domain expiry or cancellation due to non-payment. No credit notes or refunds will be issued unless a significant error has occurred on our part.

7. Duration, Renewal, and Expiry

Domain registrations are for periods of one (1) to ten (10) years as selected at the time of registration. It is the Registrant’s responsibility to ensure timely renewal.

Renewal notifications: Lab41 will provide at least one expiry notice a minimum of 30 days before the domain name expires.

Grace periods: After expiry, a domain name enters a 90-day renewal grace period during which it may still be renewed (a late renewal or redemption fee may apply). After the grace period, the domain name may be suspended and then deleted from the Register after approximately 95 days.

Auto-renewal: Where auto-renewal is enabled and payment details are on file, Lab41 will attempt to renew the domain automatically before expiry. The Registrant may opt out of auto-renewal by notifying us in writing at least 14 days before the renewal date.

8. Consumer Cancellation Rights

If the Registrant is a consumer (a natural person acting for purposes outside their trade, business, craft, or profession), the Registrant may have the right to cancel a domain registration within 14 days of the date of registration, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

To exercise this right, the Registrant must notify Lab41 in writing within the 14-day period. Where domain registration has already been completed with the registry during this period, the Registrant acknowledges that registry fees are non-refundable, and any refund will be limited to Lab41’s service fee only.

9. Cancellation by Lab41 or Nominet

Nominet may cancel, suspend, or apply special status to a domain name if:

  • The Registrant provides significantly inaccurate, incorrect, unreliable, or false contact details.
  • The domain name’s use endangers the stability or integrity of the domain name system, its users, or their equipment.
  • The Registrant breaches Nominet’s Terms and Conditions (a 30-day cure period will normally be provided).
  • A valid court order requires it.
  • A DRS Expert decision requires cancellation or transfer.
  • For natural persons: no transfer is effected within one year of the Registrant’s death.
  • For non-natural persons: upon liquidation, disbandment, or dissolution of the Registrant.

Lab41 reserves the right to suspend or cancel a domain registration where prohibited use is identified, without prior notice where necessary to prevent harm.

10. Transfer of Domain Names

Domain transfers (to another registrar or to a new registrant) are subject to the policies of Nominet and the relevant registrar. An IPS tag change will be initiated upon written request from the verified Registrant.

Transfers may be subject to a 60-day lock period following initial registration or a previous transfer. Lab41 will process transfer requests as promptly as reasonably possible and will not unreasonably withhold or delay a transfer.

11. Domain Name Disputes — Nominet DRS

All .uk domain names (including .co.uk, .org.uk, and .me.uk) are subject to the Nominet Dispute Resolution Service (DRS) Policy, not the ICANN Uniform Domain Name Dispute Resolution Policy (UDRP), which applies only to generic top-level domains (.com, .net, .org, etc.).

By registering a .uk domain name, the Registrant agrees to be bound by the DRS Policy. The DRS tests whether a domain name registration is an “abusive registration” — that is, whether it was registered or used in a manner which unfairly took advantage of, or was unfairly detrimental to, the complainant’s rights.

The DRS process includes:

  • A mandatory free mediation stage before any formal proceedings.
  • An Expert decision, issued within approximately three weeks of referral.
  • An appeal to a three-Expert panel, available within 10 days of the initial decision.

Nominet will not be liable for anything done or not done in connection with DRS proceedings unless acting in bad faith. Lab41 will cooperate fully with DRS proceedings as required.

12. Nature of Domain Names

Domain names are not property. A registration grants the Registrant a right to use the domain name in accordance with the applicable terms and policies; it does not confer any ownership rights. Nominet will not record mortgage or other security obligations over domain names. Nominet owns the copyright and database rights in the Register.

13. Personal Data and WHOIS

Registration data may be made available by Nominet via:

  • The Register.
  • The WHOIS or Searchable WHOIS service (where the Registrant has consented).
  • Disclosure to persons with a legitimate reason, under exemptions provided by data protection law.
  • The current or proposed registrar.
  • In the context of DRS proceedings.

Individuals registering domain names for non-commercial purposes may opt out of having their personal data published via WHOIS. We process all personal data in accordance with applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

14. Prohibited Uses

The Registrant must not use a registered domain name for:

  • Distributing malware, phishing content, or other malicious material.
  • Infringing the trademark, copyright, or other intellectual property rights of third parties.
  • Engaging in spam or unsolicited electronic communications.
  • Any activity that is unlawful under applicable law.

15. Abuse Reporting

Reports of domain name abuse may be submitted via our contact form. Lab41 will acknowledge receipt of abuse complaints within five (5) working days and investigate promptly.

16. Limitation of Liability

Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence.

Lab41’s total liability in connection with domain registration services is limited to the fees paid for the specific registration giving rise to the claim. Lab41 is not liable for any loss of profits, revenue, business, contracts, anticipated savings, or any indirect, consequential, or special losses arising from domain registration, expiry, transfer, or dispute.

Nominet’s total aggregate liability is capped at £5,000. Consumer statutory rights are not affected by these limitations.

17. Amendments

Lab41 reserves the right to update these Terms at any time. Material changes will be communicated to active clients before they take effect. Continued use of our domain registration services after notification of changes constitutes acceptance of the updated Terms. Nominet also reserves the right to amend its own Terms and Conditions at any time.

18. Severability and Third Party Rights

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect. No person other than the parties to these Terms may enforce any provision under the Contracts (Rights of Third Parties) Act 1999.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Consumers resident in Scotland or Northern Ireland may bring proceedings in their local courts.
